Standard Terms and Conditions

USER AGREEMENT

We are Kamvelta Travels and we look forward to the opportunity to act as your booking agent for your travel needs. These terms and conditions (the “Agreement”) describe what you are legally entitled to expect from us when you purchase travel related services through us, in addition to your obligations as a customer. The terms “we”, “us” and “our” refer to Kamvelta Travels. The term “you” refers to the customer visiting our website, booking a reservation through us or otherwise using our services.

If you do not agree to these terms, please do not use this Website. Kamvelta Travels may, without notice to you, at any time revise these Terms of Use and any other information contained in this Website by updating this posting. Kamvelta Travels may also make improvements or changes in the products, services, or programs described in this site at any time without notice.
All services provided by Kamvelta Travels are subject to the following terms and conditions
“Services” refers to any one or more of the followings; (a) Transport (b) Accommodation (c) Other tourist services.

BOOKING CONDITIONS

Kamvelta Travels website is owned and operated by Kamvelta Travels, with office located at Kindelpitiya, Bandaragama, Sri Lanka.

Kamvelta Travels transactions with several suppliers in Sri Lanka in offering goods and services through the https://www.kamveltatravels.com/ website.

The up-to-date Booking Terms and Conditions are exhibited on our websites. These booking conditions are formulated for the protection of all parties.

1. CONFIRMATION PROCEDURE

1.1 All the clients are requested to send a written confirmation via E mail. Hence the company will send back the letter of acceptance of the confirmation.

2. SUPPLEMENTS

Below are the different supplements chargeable depending on the time and type of booking. Supplements include all taxes and service charge.

1.1 PERAHERA SUPPLIMENT DURING THE PERAHERA SEASON

All clients who stay on Kandy & Katharagama (Tissamaharama) during perahera seasons have to pay compulsory supplements charged by the respective hotels. It will be communicated in advance by the company if the supplements have been added to your tour cost.

1.2 CHRISTMAS & NEW YEAR EVE SUPPLEMENT

All clients who stay on Christmas and New Year Eve have to pay the compulsory Gala Dinner supplement charging by the hotels.

2 TRANSFER

2.1 The Company will exclusively arrange all transfers to and from the Hotels. The client is not allowed to arrange transfers themselves or with any outside party, as such bookings will not be accepted by the company unless otherwise agreed in advance.

2.2 Final amendments of arrival and departure flight number& time should be notified to the the company not less than 72 hours before arrival of clients to Sri Lanka.

3 CHILDREN

3.1 The ages for considering Infants and Children are as follows.

a. Infant : From 00 to 05.99 years
b. Child : From 06 to 11.99 years

3.2 Children sharing parents’ room will be charged at the child rate stated in the rate tables with same meal plan. For children having separate accommodations, will be treated a normal booking. The child discounts stated in this sheet are applicable depending on the child age at the time of arrival to the resort and not at the time when the booking is made.

4 CANCELLATIONS, NO-SHOWS, EARLY CHECK IN & LATE CHECK OUTS

4.1. Cancellation of bookings, No-shows and Early departures will be charged as follows. Charges will be based on the same meal plan of the booking.

4.1.1. Individual Bookings

30 days prior to arrival date: NIL
Less than 30 before days to arrival date: 50% of the entire stay
No-shows and Early departure: 100% of the entire stay

4.1.2. Group Bookings

45 – 15 days prior to arrival date: 50% of the entire stay
Less than 15 days to arrival date: 100% of the entire stay
No-shows and Early departure: 100% of the entire stay

4.2. No Cancellation is charged for bookings confirmed and cancelled within the release period.

4.3. Cancellations made on the arrival date will be considered as no-show

4.4. Shifting of booking date and change of names after release period will be considered as cancellation.

5. INVOICE & PAYMENT

5.1 Proforma Invoice is to be pre – paid within 03 days of tour confirmation unless client has agreed with the company.

5.2 All payments can be made to Kamvelta Travels and Tours in two ways,

5.2.1 Payment can be made via telegraphic transfer (TT) to the below given bank account identifying the invoices for which the payment is made.The Client shall bear all the remittance charges involved at his end or charges of corresponding banks of outside Sri Lanka. The Company will bear only the local bank’s charges.

5.2.2 Company accepts credit card payments with Master or Visa via online. Note that the cardholder must present at the tour,when making balance payments with the credit card there will another 4.5% from client’s payment price. To proceed with the credit card payments company need client to send his or her passport copy and address.

5.3 Company accepts payment in US$, Sterling, Euro, Singapore $, Malaysian Ringgit, Australian$ or LKR rupees.

5.4 The Client shall bear all the remittance charges involved at his or her end or charges of corresponding banks of outside Sri Lanka.

6. COMPLAINTS

6.1. If the clients have a complaint regarding any arrangements or services whilst in the tour, clients must immediately notify the Company of the services in question and log a report during their stay.

6.2. Such complaints shall be reported by the guest(s) to Company management [via email to:info@kamveltatravels.com] within 14 days from the date of departure. The Company is not liable for any compensation claims after this deadline.

8. HEALTH. PASSPORT AND VISAS

It is your duty to ensure that you and other members of your party gain the right inoculations and medical advice before you travel. Similarly, it is your duty to certify that you and other members of your party have correct and valid passports, visas and have conformed to all other requirements pertaining to your travel arrangements before the holiday commences.

Should you require assistance on this matter we will be pleased to make recommendations. We will not be held responsible for you travelling without the correct travel documents.

9. BREAKAGES AND DAMAGES

You will be in charge for any breakages, losses or damage caused by you or a member of your party during your stay in the accommodation. It is your duty to put right the damage or to make full payment to the supplier before departure and to cover us against any losses, damages or claims made against us.

10. TRAVEL INSURANCE

You are strongly suggested to take out personal travel insurance, at the time of booking, for all members of your party. It is your duty to certify that the insurance you purchase is acceptable. Booking acceptance shall be considered to include your confirmation that you have taken out such insurance.

11. BEHAVIOR

You are responsible for compliance with all relevant regulations governing carriage by air or any other mode of transport and your stay during your holiday. If in the opinion of our suppliers/service providers and/or guide representative your behavior is disruptive or causing distress, injury or danger to other clients, our staff or any other third party, your holiday may be terminated and we shall not be responsible for any costs or claims that are incurred.

12. SEVERABILITY

If any of these Booking Conditions are invalid or unenforceable then subject to law, all other provisions of these Booking Conditions shall be and continue to be valid and enforceable.

13. ARBITRATION

When your booking is confirmed with us, a contract between Kamvelta Travels and / or you is constituted.

That contract and these Booking Terms and Conditions shall be governed in all respects by the laws of Sri Lanka.

14. EXCLUSION OF LIABILITY

Kamvelta Travels does not assurance that all information accessible is free from errors or omissions but we will use all sensible endeavors to correct any errors or omissions once notified of them. Our views are our own. Whilst we thoroughly strive for accuracy, these opinions are necessarily subjective to some degree. All recommendations, views expressed and prices regarding properties and/or destinations displayed are provided for guidance only. You agree as the user that the use of, or reliance upon, any of the content of the Kamvelta Travels website, and in particular any content recommending any hotel, product or service, is done entirely at your risk. (Including content in subsequent itinerary documents sent to you) our web site links are providing to you for your orientation and ease only. We do not own or control the content of those websites and are not responsible for their content or your use of them.

We have strived to portray and describe each hotel and/or service as best we can and also to provide the most up to date information through our website and other communications with you to the best of our knowledge.

We cannot be held accountable for any discrepancies or differences that might arise between the content of our website (text, images etc), any communication sent to you (via email, fax etc) and the actual property you are accommodated at or the service you are extended.

15. INFORMATION PROVIDED BY YOU

The information provided by you should be true and accurate. We will treat it confidentially and not forward it to any third party. We have a strict anti-fraud policy and take responsible steps to shield personal information such as credit card details.

16. SHOPPING

Kamvelta Travels, under no circumstances, commends or assurances the value or the quality of any additional product not clearly itemized on the Travel itinerary which may be purchased during an itinerary arranged in part or whole by US, even in the case where the product may have been discussed between a client and an employee or representative of Kamvelta Travels.
Determining the value of a product is completely the client’s responsibility. Sri Lanka tour packages have no duty to interfere in such circumstances and cannot be held responsible for subsequent complaints.

17. INDEMNIFICATION

You agree to preserve and assure Kamvelta Travels, its affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by: (i) you or on your behalf in excess of the liability described above; or (ii) by third parties as a result of (a) your breach of this agreement or the documents referenced herein, (b) your destruction of any law or the rights of a third party, or (c) your use of this website.

18. ELECTRONIC COMMUNICATIONS

Once you visit our website or send emails to us, you always communicate with us electronically. You accord to receive communications from us electronically and by fax. You agree that all notices, exposes, agreements and other communications that we provide to you electronically or by fax satisfy any legal requirements that communications be in writing.

The content of the Kamvelta Travels website or of any goods or services offered on the site does not make no representations or warranties, and hereby excludes all warranties, express or implied, as to the quality, accuracy, feasibility or credibility. Moreover, Kamvelta accepts no liability for any virus or any other type of electronic infection that may be transferred through the site. Under no circumstance will we be liable for any loss or damage caused by a user’s reliance on information obtained through this site.

We do not take charge for consumer comments made in interactive areas of the website, but we do reserve the right to modest them to comply with Sri Lankan law.

19. COPYRIGHT AND SERVICE/TRADEMARKS

This Site and its contents are protected by copyright, all rights reserved. All works of authorship contained at this Site, including, but not limited to, text, images, and their arrangement, are owned by Kamvelta Travels (except as otherwise noted). Kamvelta Travels, and other names appearing in a type form different from that of the surrounding text are service marks owned by or licensed to Kamvelta Travels, its subsidiaries, or affiliates. Any other product name or company name mentioned in this Site may be a service/trademark of its owner. You may not reproduce, copy, or redistribute the design, layout, or individual elements of this Site design without the express written permission of Kamvelta Travels.

20. OTHER TERMS AND CONDITIONS

20.1. In the event of tax alterations by the government, during the validity of this rate sheet, the Company reserves the absolute right to collect the revised tax without prior notice. Thus, the increased amount shall be borne by the Client unless otherwise agreed with the company.

20.2. The Client shall abide by above terms and conditions. All disputes arising hereof, or any doubts in the interpretation of this terms and conditions shall be settled mutually, with sincere negotiations, failing such disputes will be settled under an appropriate Court of Law in the Sri Lanka.

21. GOVERNING LAW AND JURISDICTION
These terms and conditions are subject to the Laws of Sri Lanka.
